How to avoid it?


As we mentioned in the entry of the origins of Organ Trafficking, it began because of an over demand of organs and the selfishness among the individuals. So, in order to avoid the organ trafficking, we must satisfy its demand and improve our laws for the transplants to be easier. 

All over the world, several laws and agreements have been signed in order to punish the organ trafficking, but unfortunately in countries such as Mexico, India and Pakistan they should still be modified for improving their efficiency. For example, in Mexico there’s an inexistence of norms to classify the organ’s donation, they do not specify how a donation was unforced, and they do not even establish the medical conditions it must have. Mexican law case is so undefined that even though the importance of specifying the approved techniques to transplant an organ, there’s no law, norm or agreement concerning this essential topic.

There’s no doubt about the need to enforce and improve Mexican law in order to have a well-organized donation system. 

Also, as we mentioned it lately, our legislators have been working in several reforms concerning the topic; but, if demand is not satisfied, this type of organized crime will still occur around Mexican territory and surroundings. That is the reason why it is needed that the amount of people willing to donate their organs when they die increases immediately. For example, countries like Spain and Uruguay had done laws to force all their citizens that are not underage to be potential donors when they die, unless they had written before that they do not want to.

This law has been approved and applied on Spain, but, since it has recently been approved on Uruguay, it will be applied until next year (2013).

In Mexico City, as well as in Tijuana (a city of the State Baja California) it has also been approved and applied a law which determines that all the citizens overage will be donors when they die unless they had written the opposite before.

As we can notice, the laws and the supply of organs are very important factors to avoid the organ trafficking and if in our city or country does not exist any law that establishes that when we die we will be donors, we could tell our relatives to donate our organs when we die. With this simple action we could help a lot to avoid this crime.

What about Mexican Law?

It's a reality that any kind of Black Market should be fought, not only by individual awareness, but also by public legislations and prosecutions, so a fundamental question is: what are out authorities doig in order to stop, or at least regulate and prosecute, organ trafficking around Mexican territory?

During Calderon's government's period, it was known that the country entered to a "war" against drugs trafficking, but what about other kind of crimes of the same type? Well in the case of Organ Trafficking, several legislations of existant laws were accomplished, but probably the best achievement of the Legislative Power was to create a new law that encompass clasiffication and punishment of several kinds of organized crime: Ley General para Prevenir, Sancionar y Erradicar los Delitos en Materia de Trata de Personas y para la Protección y Asistencia a Las Víctimas de Estos Delitos”.

The most relevant ponit concerning the main topic of our blog is that, this law establishes that if someone extracts, removes or obtains the tissue or organ of an alive human, without including the legal procedures, in which the person that will get rid of his/her organ agrees, the punishment will be from 15 up to 25 years in jail and a penalty from two thousand up to three thousand days of wage.

Origins: Demand Dilemma

We have been talking about Organ Trafficking, we have been publishing some stadistics and recent news, but the best way for understanding this phenomenon is to know how did it start? How was that a great medical and technological advance for humanity suffer a transition to a horrible way of loosing body parts?

During the 1950's, organ transplantation was settled as an experimental surgical procedure. Since that very decade , transplants among people were developed and improved converting themselves in a very benefical procedures for human race. It was the chance of donating and receiving life, the chance of creating selfless love between individuals... The bad side came when selfish and clever people realised how benefical for themselves would be to open a Black Market which goal is to supply body parts.

As we know, trade existance depends directly in its demand; if there's no demand, there's no market... Then we DO have a demand in Organ Trafficking. Constantly, people who need an organ must wait in a list, probably is not very efficient but it is fair, what happens when that people cannot wait (or does not want to wait) and have the economic resources for paying any monetary quantity? Now we have the demand.

Time for reflection...

We don´t know when are we going to need an organ, regardless if it is for us or a close person like family or a friend. So giving thoughts to this situation can help us to overcome this situation without incurring into illegal practices. The real question is: How much is worth a life?

Someday we may need an organ, but are you willing to buy an illegal one? Think about the background of that organ. You can start thinking of the precedence of that organ. You can think of any African or South American country. Now think of the conditions in which that organ was taken. Maybe someone was killed to obtain that organ you desperately need. Maybe some father who supported his family now is not going to be able to provide for its family. Maybe a girl has disappeared leaving his parents in great worries. Maybe… a lot of things could happen to a lot of different people so you can have that illegal kidney. But, are you willing to have that dirty-blooded kidney inside you for the rest of your life?

The best option is to know how to react against this situations. It may be hard to think that we may be in this kind of position one day, but there is nothing bad on preventing these things. It can be helpful to know what your laws says about this practices. Also to verify the precedence of the organ we are acquiring. And finally to neglect any illegal organ we may be offered when in need.
